DOT increases trucking violation fines

Truck drivers and trucking companies face difficult fines for traffic violations, which can have a huge financial impact. Now it appears those penalties are a little higher.

Effective November 26, 2018, the U.S. Department of Transportation (DOT) raised its fines for federal violations. This change is intended to stay on pace with inflation as required by federal law. The increase is a little over one percent, but the monetary impact for many infractions is an increase of hundreds of dollars.

Among the violations that are increasing by hundreds of dollars are:

  • Failure to obey Subpoena (maximum): From $10,450 to $10,663
  • Requiring or permitting operation of commercial motor vehicle (CMV) by driver: From $18,107 to $18,477
  • Requiring or permitting operation of CMV or intermodal equipment that was placed out of service: From $18,107 to $18,477
  • Failure to cease operations as ordered: From $26,126 to $26,659
  • Operating in violation of order: From $22,957 to $23,426
  • Conducting operations during suspension or revocation for failure to pay penalties: From $14,739 to $15,040
  • Conducting operations during suspension or revocation: From $22,957 to $23,426

These fines are in addition to any state fines truck divers or companies may incur. As a result, the financial impact can pile up quickly for those working in CMV transportation.

Drivers and business owners who are facing unrealistic fines can work with a defense attorney with experience representing trucking violations to reduce the impact of the citation. A lawyer with knowledge about how DOT regulations work can argue a case to help keep fines low.
